A Republican Congresswoman is calling on Attorney General Merrick Garland to invoke the 25th Amendment to remove President Joe Biden from his position. The demand comes after Justice Department special counsel Robert Hur released a report finding no fault with the President's handling of classified documents, despite suggesting that the President may suffer from memory issues.

In a letter addressed to Garland, GOP Representative Claudia Tenney voiced her "grave concerns" about the implications of the report. The decision by the special counsel not to press charges against the President was seen as "alarming" by Tenney. Within his report, Hur claimed there was not enough evidence to definitively prove Biden's guilt, a necessity for pursuing criminal charges. However, he also suggested that the President might present himself as a "sympathetic, well-meaning, elderly man with a poor memory" – an assertion that Democrats have attacked as being politically motivated. They argue that the report takes things out of context and furthers a predetermined agenda.

In her letter, Tenney stated that dismissals and prosecutions should not be based on personality perceptions, but on concrete evidence. She reiterated that if substantial evidence is found, charges must be made, and Biden should either be charged or removed from office. She also stated that Garland has a responsibility to initiate Biden's removal process via the 25th Amendment if necessary. It should be noted that Tenney did not advocate for invoking the 25th Amendment during the 2021 riots incited by the then U.S. President, which resulted in multiple deaths.
