Appeal results in Everton's Premier League deduction being reduced from ten points to six
After a successful appeal, Everton's initial 10-point Premier League deduction has been decreased to six points.
The breach of Profit & Sustainability (PSR) rules of the Premier League in November led to the original punishment given to the Toffees.
Following the return of four points, Everton has now risen to the 15th place in the Premier League table, ahead of Brentford and Nottingham Forest.
An announcement from the Everton club stated: 'An Appeal Board concluded that the Premier League's independent Commission's points deduction from November should be adjusted from 10 points to six with immediate effect, Everton can confirm.
'Although the Club is digesting the decision of the Appeal Board, we are pleased that our appeal has led to a decrease in the points sanction.
'We understand that 10-point deduction imposed initially seemed excessive when compared with the available reference points, including the EFL regulations and the Premier League’s insolvency rules, which the Club made the Commission aware of.
'The Club is particularly happy with the decision of the Appeal Board to annul the original Commission’s verdict that the Club did not act in absolute good faith.This decision, alongside reducing the points penalty, was a hugely significant principle point for the Club on the appeal. The Club feels justified in pursuing its appeal.
'Despite the decision of the Appeal Board and the positive outcome, the Club continues to fully cooperate with Premier League for the ongoing proceedings for theaccounting term that ended in June 2023.
'The wider implications of the decision are still under consideration by the Club, and no further comments will be made at this point. The Club wishes to recognize its Fan Advisory Board and other fan groups throughout this process, along with all Evertonians for their ongoing support and patience.'
The Club was found guilty of incurring losses over a three-year period exceeding the standard £105m in violation of the PSR rules. Everton also faces another charge for the 2022/23 period PSR breaches, similar to Nottingham Forest.
A 61-page report detailing the verdict of the appeal has been published by the Premier League.
