Prenuptial Agreement in Place as Reese Witherspoon Seeks Divorce from Jim Toth
Reese Witherspoon has filed for divorce from Jim Toth, citing 'irreconcilable differences' as the reason, according to court documents obtained by PEOPLE. Witherspoon and Toth, who were married for nearly 12 years, announced their split in a joint statement last Friday. The Academy Award winner's divorce filing lists the date of separation as the same day she filed and states that the couple has a pre-nuptial agreement. Witherspoon is asking the court to designate her and Toth as joint custodians of their 10-year-old son, Tennessee James.
'We have some personal news to share...' Witherspoon and the CAA talent agent began in their joint statement. 'It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness, and mutual respect for everything we have created together. Our biggest priority is our son and our entire family as we navigate this next chapter. These matters are never easy and are extremely personal. According to sources, the split was amicable as the couple remained committed to co-parenting together. Witherspoon, a headstrong and focused person, and Toth, a more laid-back individual, had been spending less and less time together while she worked. Witherspoon and Toth tied the knot in 2011 and also have a daughter named Ava Elizabeth, 23, and a son named Deacon Reese, 19, from Reese's previous marriage.
